By accessing this website on this and on each subsequent occasion you will be deemed to have accepted all of the terms and conditions that apply to its use and to the facilities and services provided by it. Please take the time to read through these before continuing to use the Website.

Definitions
Throughout this Agreement, the words the website, we, us, our, and ours refer to Classic Cars Global Ltd. (and our Affiliates, Successors or Assigns) The words you, your, and yours refer to you, a user of the Service.

Your Responsibility
In consideration of our agreeing to permit you to use the Website to search our database of vehicles, you agree that you will only use, reproduce and print materials comprising the results of such searches for your own personal, non-commercial purposes. In particular, you must not use the contact details provided by private advertisers of vehicles to contact such advertisers other than in connection with a genuine enquiry relating to the purchase by you of the vehicle in question.

You agree not to use the Website to engage in any activity which is unlawful (including but not limited to defamation, invasion of privacy, harassment, obscenity, the transmission of pornography or blasphemous or racist material). You must not use the Website to create or send any viruses, worms, Trojan horses or other files which disrupt the use of the Website or of any connected network, software or hardware. We will cooperate with any authorized legal or regulatory body in its investigation of any activity which is in breach of this Clause.

Registration Details
To gain access to certain services on the Website you will need to register (free of charge). As part of the registration process, you will be given a username and password. You agree that the information supplied with your registration will be truthful, accurate and complete. You also agree that you will not attempt to register in the name of any other individual nor will you adopt any username with we deem to be offensive. All personal information supplied by you as part of the registration process will be protected and used in accordance with the terms of our Privacy Policy.

In consideration for your use of the Service, you agree to provide true, current, accurate, and complete information about yourself as requested, and to update such information as may be necessary to keep it true, current, accurate, and complete. You agree that you will use the Service in a manner that complies with all applicable laws, and you acknowledge that you are solely responsible for any Content that you upload, download, transmit or otherwise process using the Service.

Disclosure of Content
Although we have no obligation to monitor the Content of our users, we reserve the right to monitor, retain, delete and/or disclose your Content if required to do so by law or in a good faith belief that such disclosure is reasonably necessary to comply with legal requirements, respond to claims that any Content violates the rights of third parties, or protect our rights, property, or personal safety, or that of our users, or of the public.

Termination
You agree that we, in our sole discretion, may terminate your use of and access to all or a portion of the Service, and remove and discard any content within the service, for any reason, including, without limitation, for lack of use, or if we believe that you have violated this Agreement. You agree that any termination of your access to the Service may be effected without prior notice, and acknowledge and agree that we may immediately deactivate or delete your account and all related information, Content, or other files in your account and/or prevent any further access to such files or the Service. Further, you agree that we shall not be liable to you or any third party as a result of our termination of your access to the Service.

Termination / deletion of advertisements can be achieved in the following ways;

The seller deletes the advert from the Website via their account (MY CCG) or instructs our customer services to delete the advert on their behalf.

The advertisement will be deleted by the system in the event that it is not renewed after the initial 180 day period and the two subsequent automated emails have been sent reminding the seller of the adverts status - Refer to Advert Pricing and Renewal.

The advertisement will be deleted by the Website administrators if the seller has deemed to have violated this agreement.

Website Content
The pages contained in the Website may contain technical inaccuracies and typographical errors. The information in these pages may be updated from time to time and may at times be out of date. We accept no responsibility for keeping the information in these pages up to date or liability for any failure to do so.

The information contained in the material in the Website is only for information purposes. The material on the Website does not constitute advice and you should not rely on any material on the Website to make (or refrain from making) any decision or take (or refrain from taking) any action.

The Website contains material submitted and created by Private Users and Dealers and other third parties. We exclude all liability for any illegality arising from or error, omission or inaccuracy in such material.

The Website is not involved in the sale of the vehicle in any way but merely a facilitator for the transaction and we give no warranties, conditions, guarantees or representations, express or implied, as to;

the completeness or accuracy of the advice and information contained on the Website or any website to which it is linked;

the content of the advertisements for vehicles included in our database, including but not limited to the ownership, quality, authenticity of any photographs, compliance with description or fitness for purpose of any such vehicles;

the completeness of the results of any search of our database or that the vehicles selected by the search are the only vehicles on our database which might meet the searcher's requirements.

Content of Adverts
All Adverts must be legal, decent, honest and truthful. You confirm that you have all relevant consents licenses and approvals to publish the Advert and that such publication shall not breach of any third party intellectual property or other rights. You confirm that you have the right to sell the goods being advertised. We will cooperate with any authorized legal or regulatory body in its investigation of any activity which is in breach of this Clause.

Adverts must be for car related items or services and entered in the appropriate category. Adverts for inappropriate items or services or those placed in the wrong category may be deleted.

You must ensure that you are legally able to sell each item included in an Advert, and that it is lawful to sell and export such item to a person resident in the buyer's jurisdiction.

Each Advert should normally be for a single item, exceptions will be considered on an individual basis.

Advertisers must place Adverts in a fair and responsible manner. Examples of unfair use would be:

         1. Multiple Adverts for the same item;
         2. Adverts which are misleading or withhold information which would affect a buyer's decision whether to   purchase;
         3. Dealers submitting Adverts for placement as private sellers.

All Adverts are submitted subject to these terms and conditions. If you do not agree to the terms and conditions please do not submit your advertisement.

Translation Services
The Websites translation service is provided by machine translation robots and as such the pages contained in the Website may contain technical inaccuracies and typographical errors for which we accept no responsibility. The translation service is provided purely as a convenience to any non English reading visitors to the Website - particular care should be taken when translating the description for any vehicle being advertise on the Website.

Editorial Rights
By submitting an Advert to us, you assign all copyright in the advert to us and agree to waive all moral rights in relation to the Advert. We have absolute discretion: to publish or not publish the Advert on the Website; to amend or edit the Advert prior to publication; and to remove the Advert from the Website.

Advert Pricing and Renewal
The “List Until Sold, One Time Fee” is based upon the user placing an advert on the ClassicCarsGlobal.com website abiding by these Term and Conditions. The fee charged is for a 180 day (6 months) advertising period - Any adverts that are still live after this period are being advertised free of charge.

To renew any adverts free of charge for a further 180 day period the user will be required to sign-in to the Website with their username and password used at registration. Each time the user logs into their account any adverts they have running are automatically renewed for a further 180 days. If after a 180 day period there has been no account activity (sign-in) and the user has a “Live” advert on the site then an automated email will be sent out reminding the user of the status of the advert and that they are required to sign-in to their account to renew their listing.. If after a further two weeks (28 days total) there has been no reply the advert will be deleted from the system database allowing the site to be kept up to date and efficient.

Refunds
As with other online classified services ClassicCarsGlobal.com does not generally offer refunds for listing fees. Upon completion of payment, online exposure to your vehicle is immediate - therefore refunds for the following will not be accepted;

You change your mind about the listing

You sell the vehicle through other means.

You have not received inquiries or offers to purchase your vehicle

However a refund will be issued if you have by accident purchased a duplicate advertisement.

Copyright and Trade Marks
All rights, including copyright, in the content of these web pages and in the photographs of any vehicles displayed on the Website from time to time and all database rights in our database of vehicles, are owned or controlled for these purposes by us.

All trade marks, names, and logos are the proprietary marks of ClassicCarsGlobal.com. "Find your next classic" is a service mark of ClassicCarsGlobal.com. No license to use or reproduce this mark is given or implied. Marks identifying third parties are owned or licensed by those third parties or their associated companies. All other brands and product names are the trademarks of their respective owners. Nothing in these terms and conditions in any way confers on you any license or right under any trade marks, names or logos.

Except where expressly permitted (i.e the CCG.com Affiliate Program, Link To Us, etc.), you may not copy, reproduce, redistribute, download, republish, transmit, display, adapt, alter, create derivative works from or otherwise extract or re-utilize any of the contents of the Website. In particular, you must not cache any of the contents for access by third parties nor mirror or frame any of the content of the Website nor incorporate it into another website without our express written permission.

Product and Service Descriptions

We are not car dealers; any listing information about a particular car comes directly from the seller and not us. Whenever buying or selling a vehicle online always use your best judgement. Indemnity
You agree that you are responsible for all complaints, legal actions or threatened legal actions relating to an Advert and agree to keep us indemnified from all costs, damages and other losses howsoever arising from the publication of any Advert on the Website (excluding those losses arising exclusively from editorial changes made by us on your Advert) including without limitation any costs incurred by us in enforcing our rights under these conditions.

You agree to further indemnify us against any losses we suffer as a result of your sending us material containing viruses or other files which cause damage or corruption to the Website or to our IT systems.

Dealers Status
Qualification - Any company actively engaged in the business of selling vehicles will be considered for dealer status. Therefore to qualify you must be a franchised dealership, dealer group or independent dealer. Before dealer account status can be given, the terms and conditions detailed in this document have to be agreed to.

Once you sign up as a dealer to the Website the data you supply relating to your dealership will be posted to our database and you will be contacted to verify your existence and the fact that you actually are who you say you are. Once that is done we will verify your account and you will be free to list your inventory.

Recurring Payments - In the event that the Dealer chooses to list their inventory (up to 30 vehicles) for a recurring monthly fee, credit cards are accepted and no additional charges for their use are applied. The cardholder must be a current verifiable employee of the company advertising.

Either party may terminate this Contract without cause on thirty (30) days’ prior written notice to the other party. Your verbal termination is not acceptable. The Website may cancel an advert or terminate this contract immediately if you breach any provision of this contract. If you remove all of your ads from ClassicCarsGlobal.com it does not automatically terminate this contract and you will continue to be charged the applicable monthly recurring charge set forth, plus any applicable taxes and other charges, even if you are not currently running any advertisements.

General
We reserve the right to assign or subcontract any or all of our rights and obligations under these terms and conditions to a third party. If we exercise this right, we shall name the assignee or subcontractor on the Website and you will be entitled to terminate the account within 5 working days. You may not without our prior written consent assign or dispose of any rights or obligations arising under these terms and conditions.

These terms and conditions of access together with our Privacy Policy contain the entire agreement and understanding between the parties relating to the Website, and supersede any and all prior agreements, arrangements, statements and understandings, except for any fraud or fraudulent representation by either party. We exclude all representations and warranties relating to access to use of the Website, whether they are statutory or otherwise, as far as is possible by law.

If any provision of these conditions is unlawful, void or unenforceable then that provision shall be deemed deleted and its deletion shall not affect the validity and enforceability of the remaining provisions. No failure by us to exercise any of our rights under these conditions shall operate as a waiver of our rights.

Your rights under these conditions are personal to you and us and you shall not assign or transfer them. We shall be able to assign or transfer our rights under these conditions at will.

Governing Law and Jurisdiction
These terms shall be governed by and interpreted in accordance with English law and you irrevocably agree that the courts of England and Wales shall (subject to the provision below) have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms. For our exclusive benefit, we shall retain the right to bring proceedings as to the substance of the matter in the courts of your country of residence or, where these terms are entered into in the course of your trade or profession, the country of your principal place of business.

Modification of Terms
Because the web is an evolving medium we reserve the right to alter these terms and conditions at any time and it is your obligation to check if changes have been made. Your use of the Website after changes are posted on-line shall constitute acceptance of the new terms and conditions.
